Bummer. Let's all have a discussion about who had right of way. Was there damage on the bow of the scallop boat?
 
The tug with the tow had right-of-way. Anything under/with a tow has the right-of-way.
 
It was in a marked channel, you really can't fish there. A tug with a 500 ft. barge can't do anything. Fault the fishing boat.

I know this is simplistic - but I tend to assume the boat with the stove in bow had the biggest case of the stoopid.
 
+1 I'm "thinking". Like, uh, significant duh factor by someone fishing that thinks they have right of way over commercial traffic that is less maneuverable.

Some people confuse COLREGS with the laws of physics. Incidents as such - stand-on, give way, that's for the insurance lawyers and investigators to figure out. As for me - I'll keep my crew alive rather than fight to the death over NavRules.

Won't find it in '72 COLREGS. If you were to look close enough, you may find that term used in the Inland side of the book, though...

With 500ft of barge, either Constrained by Draft, or Restricted in ability to maneuver?
 
However, GIVE-WAY does exist in COLREGS. Picky picky . . .
 
as does stand on, but really nothing is recognized as having "the right of way".

I have to take NAVRULES tests every few years - and I've yet to see an edition of the test that doesn't have at least one 'gotcha' question that tries to get you with the "right of way" thing, as well as one that tries to get you with a "long" blast. That's why I'm so picky. Force of habit.
