If Florida presses again, the ACF rivers might flow north. Florida should have took the first deal offered by Gov. Sonny Purdue which Florida initially agreed to then backed out. Gov. Scott really screwed up by later filing this suit.

Judge Kelly found that Georgia did not cause harm to the oyster fishing industry and that Georgia's use of the Flint and Chattahoochee Rivers is not unreasonable or inequitable. He also found that Florida did not prove Georgia caused the harm Florida has complained of – and that even if it had, the benefits of an apportionment would not substantially outweigh the harm that might result. That assessment answers the substantive questions the Supreme Court Justices asked while rejecting the previous Special Master's report and, if accepted by the Supreme Court Justices, will mean the end of this case. While there are still some other ACF cases percolating through the courts that deal with specific operational concerns, this report likely sounds the death knell for Florida's nearly three-decades-long attack on Georgia's water use in the ACF. While we may see future litigation concerning environmental issues and the Corps' management, the threat of equitable apportionment looks like it will finally go away in 2020.
