Again, assumes facts not in evidence. There is nothing illegal about a helicopter landing anywhere where it is not prohibited for any reason. Maybe they were greedy, but that does not mean they "forgot" about their fuel. They might have said, "Yeah, hang out here and we can always put it down on the beach and call for fuel.
Let me give you another example. I am flying along in my Cub. We are hunting coyotes. Hunting is good and fuel is getting low. I decide there is a field upon which I can land. Maybe it is public land without restriction or a farmer's field with whom I know I can use. So I land when low on fuel and call a buddy to bring cans. Illegal? Nope. Actionable? Nope In fact I have landed in a meadow of public land a while back so my wife could go pee.
