Busted Eisinglass - Is the Yard Responsible?

In early December, before my marina shrinkwrapped my boat, we experienced a frozen rainstorm which froze and split two of my eisinglass windshields.

I had the winterization commissioning papers signed since early October with a hauling date of middle of November (and my account was fully up to date.) I had done nothing to postpone or delay the winterization.

Who's responsible for the repair (that is replacement) of the eisinglass? Is the boat yard responsible? If not, then there is nothing compelling them to complete the winterizations on time.

What if we had experienced a deep freeze and the boat's systems weren't winterized and suffered damage?

Similarly, what if a tree limb falls and results in damage to a boat stored in the yard?

Do these damage charges just fall back on the boat owner by default?
