Sadly, you are likely to be right, we don't have a Dept Of Justice that follows the law, but we need to push for equal justice under the law.
Note that Hillary just fell to the pressure (from a judge) to turn her server over to the FBI which I never expected.
At least we can hope for some top heads to roll at the EPA.
 
3 million will be real low. I keep my boat on Lake Powell but at the south end so I don't expect any issues (anywhere on the lake). I'd assume the toxins will dilute given the volume of the lake.

I would be concerned about eating any fish caught on the north end over the coming month. I know they are monitoring the fish for increased toxin levels.
 
And since these are heavy metals, they will be in the lake sediments for ever. They won't degrade, evaporate or otherwise deteriorate since they are elemental toxins. You're stuck with them permanently. Fish will be bioconcentrating this stuff for decades, especially in the shallower rivers and tributaries. The depth of the lake will sequester some of this material over time. The EPA really screwed the pooch on this one. Heads should roll.

Aside from purely military planning, all gov't plans are flawed.
 
Accidental, or Planned.
Given the basic physics of digging into the bottom of an impounded pool of water, the lack of any possible responsibility of the EPA, and the potential for their getting a bunch of money added to their mission to take over and run this whole area; I could easily make a case for intent.

Given the visibility and prominence of this area, I could also say they would not have risked any accident if they had any fear for responsibility to be assigned; or cared a farthing for the area, or their supposed mission.
Where are the Big checks for damages and loss of property value. Where are the Green Freaks screaming and theowing rocks?
Oh, the EPA; they are the Green Freeks.

Maintenance of the bureaucracy is the only goal.
