NYS Sales tax not recorded.. Help !!

After 10 years of owning our boat, we get a letter in the mail that our sales tax for our boat cannot be verified. WTF. But I have the invoice, finance papers with the sales tax included in the sale and financing From Surfside 3 in October 2002. I believe I have seen this same issue on Boatered before.

Can anyone let me know what happened and how to proceed. I guess we are first going to send in all the papers that we have. But the canceled check for the down payment does not explicitly state what it was for, However, the invoice and finance paper do.

I suggest you send photocopies of the invoice and finance papers back to the state tax bureau or DMV, whichever sent you the notice, with an explanatory letter. Keep a copy of everything for yourself. I'd also suggest you contact Surfside 3 and let them know that you've been notified that there's no record of the tax being paid. As a matter of fact, perhaps you should contact Surfside 3 first. They should have copies of the paperwork, including the payment of the tax. After all, the boat couldn't have been registered initially if the tax wasn't paid. Hy
 
Wow, what a shakedown! I wonder how many people don't have the records that you have and end up ponying up mucho $$$. I can't imagine why your original bill of sale with the sales tax included on it wouldn't suffice. Is the dealer still in business? Perhaps the dealer didn't pass it on?
 
I got the same letter this spring, luckily, I have the registration that has the sales tax on it, which I sent in, along with a request that I get in writing that I was OK. They sent me a letter saying that I was fine and the matter was closed.

I would send copies of your paperwork and a copy of the registration, you can't register a boat without paying the sales tax. If these morons would compare their records with the DMV, you wouldn't have to put up with this harassment.
 
+1 NYS requires sales tax to register. We paid 17K for our boat back in 1999. If you are registered you should be good to go. The only issue would be if you lost the receipt for the original reggy which has the sales tax paid on it.
 
I had a similiar situation in PA. I owned the boat for 10+ years and they questioned whether I paid sales tax. The boat was purchased in MD. When it was documented in PA, we had to write a seperate check for the sales tax. I had a carbon copy of the check and after they did some research, they aknowledged that the sales tax was paid.
Paying Surfside for taxes does not mean they paid the state. The state will hold you responsible and not Surfside. Hopefully, Surfside has records of them paying the sales tax.

got the same letter 3 times for my 2004 34c, no biggie, just send them copies of your bill of sale.
 
Surfside 3 who is now Marine Max was to pay this and it is on various papers that I have. But on my original registration it just show my reg payment in 2002 and expiration date. This boat was purchased new and SS3 was to handle everything and even states the tax on my finance documents. If you are able to register your boat they should know that the tax is paid… This is unbelievable after 10 years.
 
Another reason we are glad we left NYS.
 
Been there done that. It's a standard form. Mail it back with invoice. Case closed

Boat could be registered and sold but new owner didn't pay sales tax. So they check.

It sucks you have to deal with this while trying to sell the boat. I agree it's NYS trying to scrape up money from any and every where because this state is broke. I would send in copies of what paperwork you have and it'll be fine. NYS however will always be a mess.

10 years? How far back can they go? Even though you have proof that you paid the dealer, what if the dealer never paid the taxes, and he is no longer in business?

You cannot register a boat or car in NY without paying sales tax
End of story :)

SS3 is now Marine Max who is very much in business. True they may not have paid the tax, but it was written into the finance agreement which I am still paying to the bank.

Also as Walter states I have registered the boat, in fact at least three times since. Linda called and sent in all the paper work, so I will know next week sometime. This really sucks...
 
Sent in all the paper work and Linda followed up and actually got a human on the phone. They reviewed the documents and "Case Closed"
 
Dave is right, you don't want to deal with this again. I asked for, and received, written confirmation that I had paid my tax.
