Hard to believe that after over 2 yrs. we finally start in court tomorrow to get our money back from the boat broker that was supposed to build a custom trawler for us.
 
Dusty, I hope you can get punitive damages as well for the aggravation. Good luck!
 
Good luck. I can't believe they did not cough up the money.
 
It was finally built and sold, but not by this broker. Wrong engines,,granite not entirely through boat, , wrong seating on flybr. and incorrect helm chair etc--etc...but he for the past 2 yrs. has believed he deserves that money. We wil see? He is on his 4th lawyer due to lack of payment.
 
HI Dusty, I wish you luck in this trial. Never esay on the nerves. I have been to court several times and found the judges to be very fair toward the person who lost their money. Good luck, Steve

Best of luck to you and Barbara. This has been quite a saga... do you still have the pictures I took of the boat while it was under construction in China? I remember specifically asking about the engines that were planned for her and getting a very vague reply from the broker's rep. Shame, because the builder is a hell of a good guy but I guess he was scammed by the broker as well. I hope you (1) beat the crap out of Ed in court, and (2) are able to find some money in that guy's rat nest of a business. (Is he still in business???)
 
The worst part of this is yet to come even if and when you do win your case. Trying to "Collect" will probably be harder than winning.

Thanks all,,went ready for trial and offered a settlement,,finally. Not great/great..but get fair amount back with a good judgement, that kicks in against corp. if not done on sch.
I know some have commented about airing problem folks on the boards, but 'trust me' stay away from this guy and group if you are interested in one of their boats. Martin Assoc. Yacht Group.

Dusty, facts are facts. What went on in court is public knowledge. To heck with anybody that doesn't want truth posted online. Post the facts that we all need to know. I'm happy for you that you got some justice in this.
 
Congrats Dusty. There's a reason that the court proceedings and the settlement agreement went so quickly.... the defendant was guilty as hell!!! No question. BTW, having dealt with Martin Associates myself I will second Dusty's warning!
 
Mike I still have those pics. Part of other things they did wrong. We have some $ coming back, with a 'consent judgement' against their hidden corp. if he misses any payments. All we have to do is serve court with document, and they have to open corp. to holdings.
If anyone is coming to this late,,we contracted to have a custom trawler built from a Chesap. broker and he took the 1/4 mil downpayment, and sent a small amount to builder and spent the rest. When we found they weren't building to our specs,we cancl. and he would not return any $. Boat was finished and sold to someone but not by this broker, in fact they are no longer brokers for this builder.

Ouch! I hope you are somewhere near whole now financially after this?
 
Judgement in your favor don't equal money in your pocket. How do you collect from someone with no money? I hope this works out. Two years is not that bad a wait. It is four plus years post Katrina and many homeowner's law suits against insurance companines are still pending.
