water depth

i would really appreciate a person with experience to help me out. I am a current owner of a 26 maxum. I live in toms river nj, and the water in the bay is quite low. I have a house with a dock in the back where the water is only 2 feet. i am building it out and fighting with the state as i want a bigger boat. they say they will give me approval to get to 3 feet mean waer line at low tide. Is taht enough to get a donzi 38zr or a comprable high performance boat. I am dying to get a bigger boat but worried about the low water.. Any help would be greatly appreciated thx u michael
