Overloaded - and Capsized

here in miami you recognize many of the ghetto charters thanks to their pink sumbrella! I bet this is the only market when Sunbrella sells in that color… and these three are far from the most graphics!

This is one thing that surprised me about Watts Bar Lake in eastern TN… no crowds, no idiots. This is the second summer we have the boat up there and most coves are empty even on week ends. We were up there for July 4th and there was little traffic. Most marinas have a few ‘toons for rent but they all behave.

I don't know Pascal, pink would look nice with the fighting yellow!

And now.....the rest of the story......the Captain was an illegal! If someone had done their job, this douche bag would have never been in New York to create this kind of mayhem.

And impacting a tree at 150 kts is lot more painful than a dock at 5kts :)

Problem are the laws. USCG can only enforce existing rules, they don’t make them.
This. A lot of people blamed the marine inspectors after the dive boat Concepcion tragedy, but they enforced the existing regulations. If they refused a COI because it didnt seem safe to them even though it was compliant with existing regulations - the very same people would be up in arms.

(In that instance, I wholeheartedly agree the egress situation shouldn’t have been allowed under subchapter T - but it was. Not sure, but I believe that’s since been changed.)

The point I have been trying to make is there is too much wiggle room in marine for hire operations. For hire means the public trust is at stake and there should be no compromise on safety. After the Colgan crash the nation demanded and got, "one level of safety". IOW commuters and small air carriers were not allowed to operate at a different levels of safety. All pilots had to be ATPs and all aircraft inspected in the same way. As a result commuter and small air carriers safety has improved remarkably. We need "one level" in the marine world.

There is a huge difference as in aviation all operators even charter and small commuters are inspected, keep a paper trail and all operates from a restricted environment. Marine operators on the other hand operates from tens of thousands of marinas and private docks making it very difficult to inspect anything.

But again the problem is regulations which actually pushes the use of non licensed captains so small boats can carry up to 13 instead of 6. And because there are very few casualties from illegal operations, there is no urgency to change the law.

The people who do that should be handcuffed, tied to a cinder block and be destined for fish food
